WASHINGTON, D.C. — A recent article published by Politico claims that the United States Supreme Court has voted to overturn Roe v. Wade, ending the constitutional protection of abortion rights.
The website, on Monday, posted a leaked draft of a majority decision written by Justice Alito. This leak would be the first of its kind in U.S. history.
In the drafted opinion Justice Alito says, “We hold that Roe and Casey must be overruled. The Constitution makes no references to abortion, and no such right is implicitly protected by any constitutional provision.”
Alito would also say, “We can only do our job, which is to interpret the law, apply longstanding principles of stare decisis, and decide this case accordingly. We therefore hold that the Constitution does not confer a right to abortion. Roe and Casey must be overruled, and the authority to regulate abortion must be returned to the people and their elected representatives.”
The 98-page drafted majority opinion was written in February of this year. Experts say that the court’s ruling will not be final until its official publishing.
The overturning of Roe v. Wade brings a pivotal shift in American society and politic. One that has not been seen in nearly 50 years.
Democratic candidates in Ohio have weighed in on the potential ruling.
Gubenatorial candidate Nan Whaley, released a statement saying, “It has never been more important to elect a genuinely pro-choice candidate to be Ohio’s next governor.”
Democrat Senate candidate Tim Ryan added, “Overturning Roe vs. Wade would be absolutely wrong, not to mention catastrophic for Ohio, where Republicans have passed one extreme and dangerous proposal after another t ban abortion— without exceptions even for rape, incest, or medical emergencies— before most people even know they’re pregnant. We cannot sit back and allow the Supreme Court to gut Ohioans’ most fundamental rights.”
Pro-life supporters believe the overturning of Roe v. Wade is the ultimate victory.
Legal experts say the abolishing of the constitutional protection would upon the door for state and local governments to institute complete abortion bans.
Republican Senate candidate Josh Mandel took to Twitter, saying, “All men are created equal, endowed by their Creator with certain unalienable Rights, that among these are LIFE, liberty, and the pursuit of happiness. For the first time since Roe v Wade in 1973, that fundamental right, the right to LIFE, will be protected.”
There is no word when the court will make its final ruling and how closely that ruling will match the leaked draft.
