CHILLICOTHE, Ohio — Adena Health System is facing a lawsuit filed by a former employee, claiming retaliation under the Ohio Whistleblower Statute, according to court documents filed in Ross County on Thursday.
Dustin Eing, a resident of Lucasville in Scioto County, initiated the lawsuit, alleging wrongful termination after he reported a colleague for stealing fentanyl. Eing, who was employed as a Registered Nurse and Emergency Technician until May 3, 2023, asserts his actions were in adherence with his ethical and professional obligations.
The lawsuit details that Eing had a reasonable belief that a fellow nurse’s conduct, which involved the theft of fentanyl intended for medical purposes, constituted a criminal offense. After making both verbal and written reports to the defendant, Adena Health System, Eing claims he faced adverse actions culminating in his termination.
The complaint underlines the loss of compensation, fringe benefits, and opportunities for gainful employment Eing suffered as a direct result of the alleged retaliatory actions. He is seeking relief under Ohio Revised Code §4113.52, which safeguards whistleblowers from retaliation.
The health system has yet to release a public statement regarding the current lawsuit.
Various other lawsuits have been filed against Adena, including a class action lawsuit regarding violation of labor laws.
