CHILLICOTHE, Ohio — Another week, another lawsuit filed against Adena Health System for wrongdoing. The latest suit alleges doctors and the hospital operated on the wrong side of a patient’s body.
The incident at the heart of the lawsuit unfolded at Adena’s main campus.
The lawsuit alleges that Damien Benjamin, M.D., conducted an operation in February. However, a critical error occurred during the surgery when it was discovered that the procedure was performed on the wrong side of the patient’s body. This led to further complications, including disfigurement, pain, and sexual dysfunction, the suit alleges.
The case is heavy in documentation, according to the suit.
Within the lawsuit the man’s medical records have been brought to light. These records shed further light on the alleged medical negligence and assault/battery:
1. On January 26, 2022, the man had an appointment at the hospital due to left inguinal pain. He was diagnosed with a left inguinal hernia during this visit. Medical records indicate that a surgical procedure was scheduled for February 1, 2022.
2. During the February 1, 2022, surgical procedure, Benjamin wrote in the records that the procedure was performed on the wrong side, specifically the right side. Subsequently, the procedure was performed on the correct, left side without the patient’s consent.
Furthermore, the lawsuit asserts that the defendants failed to obtain informed consent from the man before performing the procedure, which constitutes assault and battery.
The specifics from the medical records provide a more comprehensive understanding of the alleged medical negligence and the circumstances surrounding the surgical procedure performed on the wrong side of his body, which supports the suit, the complaint reads.
The allegations within the lawsuit are currently pending in court, where a legal resolution will ultimately be determined.
