CHILLICOTHE, Ohio — Roger A. Moore Sr., the former Chillicothe Police Chief, and his heating and cooling business, 1st Capital Heating & Cooling, are embroiled in a legal battle following allegations by a supply company that they have failed to settle a substantial debt.
According to documents filed in court, Moore and 1st Capital Heating & Cooling opened an account with the plaintiff, a supply company, on August 30, 2021, for the commercial purchase of goods. The agreement included a personal guarantee signed by Moore Sr. and Roger A. Moore Jr., promising payment for all purchases made on behalf of 1st Capital Heating & Cooling.
As of April 30, 2024, the debt on the account amounted, according to the court filings, to $125,322.25, which remains unpaid despite alleged multiple demands for payment by the plaintiff. The company asserts that zero payments have been received since April 30, 2024, and as of May 31, 2024, with accrued interest, the total owed has escalated to $127,828.70.
The lawsuit, which alleges breach of contract and unjust enrichment among other claims, details that despite deliveries of commercial goods to IST Capital, payments have not been forthcoming. The plaintiff seeks a judgment against Moore Sr., Moore Jr., and 1st Capital Heating & Cooling for the full amount owed, plus pre-imposed judgment interest, contractual interest, legal costs, and attorney’s fees.
Legal proceedings are ongoing, with the plaintiff pursuing remedies under Ohio state law to recover the reported outstanding debt and associated expenses.
According to the court docket, a response to the lawsuit has not been filed by the defendants.
Roger Moore, was terminated from his position as chief of police on August 22, 2014, following several accusations of insubordination, malfeasance, and conduct unbecoming of his role. An investigation reportedly substantiated many of the allegations made against him, leading to his dismissal from the police department.
